1. The Controller and general principles

We, ACROS Sport GmbH Benzstrasse 58, 71272 Renningen, Germany as operator of https://www.acros.de“ (hereinafter “Online-Shop” or “Website) are Controller for the Online-Shop user’s personal data (“you”) in the meaning of the German Data Protection Act [Bundesdatenschutzgesetz] („BDSG“).

Your confidence and the protection of your privacy is of particular concern to us. Therefore, we take the protection and the safety of your personal data very seriously. Your personal data will only be collected, processed and used observing the data protection regulations, in particular the provisions of the BDSG and the German Tele Media Act [Telemediengesetz] (TMG).

Hereinafter we will inform you in detail according to our information obligations, which data will be collected when visiting our Online-Shop and using our services and offers and how these will be processed and used by us thereafter. Furthermore, we will inform you which accompanying protective measures we have undertaken in technical and organisational means.


2. Collection and use of your personal data

a) Informational use of our Website

If you visit our Website for informational purposes only, it is not required to provide us with personal data.

We collect and use only those of your data, your internet browser transfers automatically, as for example, the addressed paged, type and operating system and the internet browser used by you, the IP-Address of the computer, date and time of the visit of our Website.

This data is collected and used by us in an anonymized way during a visit of our Website for only informational purposes in order to enable the visit of our Website, for statistical purposes and for the improvement of our internet offer. In doing so your IP-Address will be shortened by the last octet (partial segment). A linking of this data with personal data of a special individual person will not happen. Your IP-Address will be saved only temporarily for the time of your visit.


b) Use of services

If you would like to make use of the services offered in our Online-Shop, e.g. order goods or our newsletter, it is necessary that you provide us with personal data therefore. We collect and use your personal data for the following purposes:

Customer Account: When establishing your personal account we will ask you within the registration process for various data (e.g. name, address, e-mail address, date of birth and telephone number) as well as voluntarily provided data in this context (e.g. fax number) via the provided form. Your data will be used to administer your account and to provide the associated functions, as e.g. the editing of your costumer data and the display of you orders.

Orders: We collect, process and use exclusively the personal data which are necessary to fulfil, process and, if applicable, to rescind your order in our online shop. Within the ordering process we therefore collect, process and use the required data and voluntarily provided data (e.g. name, address and e-mail address, payment information, e.g. banking account as well as delivery specifications, e.g. delivery address and further information).

Contact/Feedback: If you contact us, e.g. to give us feedback, the collection, processing and use of your data provided by you voluntarily (e.g. name, e-mail address) is effected to answer your questions/proposals you made via the feedback form, e-mail or by other means.

Newsletter: You may also register for our newsletter. To this purpose, the necessary personal information that you provide to us for the purpose of newsletter subscription (such as title, name and e-mail address) is used by us for providing and sending the newsletter. The wording of your declaration of consent for the news-letter is:

“I hereby subscribe to the Newsletter (unsubscription possible at any time)”

Further information, if any, will be used only to address you personally and to individually arrange the content of the newsletter as well as to clarify questions regarding the e-mail address.

We will only send a newsletter to you after you have verified your registration by clicking a link in an e-mail sent to you for this purpose only. We want to make sure that only you yourself as the owner of the provided e-mail address is able to register for our newsletter. Your verification has to be made promptly after receiving the confirmation e-mail, otherwise the newsletter registration will be deleted automatically from our data base. You may unsubscribe from our newsletter by filling in your e-mail address in the field “unsubscribe” on the site “Newsletter”. The corresponding link may be found here (bitte verlinken) or in the options menu “Newsletter” of our Online-Shop. You can also unsubscribe our newsletter at any time on a link contained in the newsletters.

The personal data collected for the aforementioned purposes will be used only within the specific purposes or as far as it is required for our own legitimate business interests. A transfer of your personal data to third persons if and as far as this is required is only effected for the aforementioned purposes, e.g. to a bank to process the payments. Apart from that your personal data will not be transmitted to any third party without your prior consent, unless a judicial or official order obliges us to do so.


3. Cookies

We use cookies on our Website. Cookies are small text files which will be sent to your browser by our web server during your visit of our Website and will be saved on your computer for a later access of our Website.

We use so-called session cookies (also called temporary cookies), which will be saved only temporarily for the duration of your visit of our Website.  4. Google Analytics

Our Website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, enabling to analyze how you use the Website. The information generated by the cookie about your use of the Website (including your IP address) will generally be transmitted to and stored by Google on servers in the United States. In case of activation of the IP-anonymisation on this Website, Google will in advance shorten the IP address within the Member States of the European Union as well as within other countries, which are contracting parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to servers of Google in the USA and shortened there. In our account, Google will use this information for the purpose of evaluating your use of the Website, compiling reports on website activities and providing other services relating to website and internet usage vis-à-vis the website owner.

Google will not associate your IP address transferred by your browser as part of Google Analytics with any other data held by Google.

We point out that Google Analytics is used with the add on „_anonymizeIp()“ and therefore your IP address will only be processed shortened to avoid a direct personal assignment.

5. Social Media Plug-ins

Our Website uses so called Social Plug-ins (“Plug-ins”) provided by the social network Facebook, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The Plug-ins are marked with a Facebook logo.

We use for all Facebook Plug-ins on our Website so-called “2-click-buttons”. The buttons are disabled by default. Unlike the standard buttons of Facebook there is no connection with the Facebook servers in a disabled state. Only when you activate the button by clicking and thus also give your consent to connect to the website of Facebook the buttons become active and will establish a direct link to Facebook. The buttons remain active until you disable it simply by clicking again.

When calling up a website of our online-shop containing such an active Plug-in, your browser will establish a direct link to Facebook’s servers. The content of the Plug-in is transmitted directly from Facebook to your browser and is then embedded into the website.

By embedding the Plug-ins, Facebook will receive the information that you called up the respective page of our Website. If you are logged in at your Facebook account, Facebook will be able to connect your visit with your Facebook account. If you use the displayed Plug-ins, e.g. the “I like”-Button or make a comment, the respective information will be sent directly to Facebook by your browser and will be saved there.

5. Third Party Contents

Third Party Contents are integrated in our Website such as videos from YouTube. Prerequisite for this is that the provider of such content perceives the IP-address of the user to send the contents to the respective browser of the user. We endeavor only to use such contents where the respective provider uses the IP address exclusively for the delivery of the contents. However, we have no influence on whether the respective third-party provider saves the IP address e.g. for statistical purposes.


6. Data protection

We take technical and organizational precautions to secure incoming or collected personal data, in particular against accidental or deliberate manipulation, loss, deletion or against offences of unauthorized persons. Our precautions will be improved continuously according to the technological development.

Using SSL technology encrypts our Website to prevent access by unauthorised third parties.

We point out that you are entitled to revoke your data protection consent, if any, at any time with effect for the future.

Furthermore, you are entitled, to demand disclosure at any time at no charge about saved personal data concerning you, provided that the respective requirements under statutory law are met.
